The Supreme Court ruled in favor of religious schools in Our Lady of Guadalupe School v. Morrissey-Berru and St. James Catholic School v. Biel, stating that the so-called ministerial exception prevents two Catholic school teachers from bringing employment discrimination lawsuits against the schools that declined to renew their contracts. Damian was quoted in Courthouse News Service (here) and Business Insurance (here) on the decision, stating: “I think there’s going to be some overreaching or at least testing around the edges of this by the religious organizations, I would assume, and I think there is going to be a substantial amount of follow-on litigation.”
