At HNRK, Josh has represented corporate policyholders in a broad range of industries in a wide variety of insurance matters—his current clients include Syngenta (the world’s largest agrochemical company), a global conglomerate with businesses in the communications, media, and automotive sectors, and the outside directors of a well-known renewable energy company—and has obtained substantial recoveries and precedential rulings for his clients along the way. Recently, he successfully represented Syngenta in a lawsuit involving over $170 million in liability insurance in connection with nationwide class action claims alleging decades-long contamination of water sources by a Syngenta herbicide product. Earlier this year, he secured a significant appellate decision for New York policyholders, which made clear—for the first time—the minimal standard needed to plead a cause of action for bad faith claims handling. The case confirmed that New York recognizes policyholders’ ability to claim damages resulting from an insurer’s bad faith in handling claims, and identified various types of damages potentially recoverable by policyholders, including attorneys’ fees.
