Andrew N. Bourne, a partner of the firm, focuses on representing corporate and individual policyholders in insurance recovery and has represented a wide range of clients in federal and state courts across the country.

Recognized by New York Super Lawyers – Metro Edition© as a 2013, 2014 and 2015 “Rising Star” in insurance, Mr. Bourne has negotiated settlements and litigated cases involving a wide range of insurance contracts, including commercial general liability, directors and officers, errors and omissions, property and business interruption, professional liability, and multimedia errors and omissions policies, as well as fidelity bonds.

Over the course of his career, Mr. Bourne has helped secure hundreds of millions of dollars in coverage for policyholders through negotiation and settlement, arbitration, and litigation.  Outside the insurance context, Mr. Bourne represents corporate clients in a wide range of business disputes and has successfully litigated commercial and financial matters in state and federal courts.

Mr. Bourne’s recent policyholder representations include:

  • The representation of the owners of the Trump Soho Hotel in litigation with its insurer and the Consolidated Edison Company of New York concerning business interruption losses arising from ‘Superstorm’ Sandy;
  • The representation of several high profile New York City restaurants in litigations with their insurers concerning business interruption losses arising from ‘Superstorm’ Sandy;
  • The representation of a former director of a major art gallery in connection with a claim for insurance coverage arising out of a defamation lawsuit;
  • The representation of a leading hi-tech professional services firm in negotiations with its insurer concerning coverage for a class-action lawsuit alleging unfair trade practice claims;
  • The representation of a private equity portfolio green energy company in connection with a claim for insurance coverage under an Extended Warranty Contractual Liability policy;
  • The representation of a Delaware real estate holding company in connection with an insurance dispute over damage caused by fire;
  • The representation of a public agency in connection with a claim for insurance coverage under a cyber-liability insurance policy.

Prior to joining the firm, Mr. Bourne was a founding partner of Bourne & Zakheim LLP, a boutique law firm dedicated to representing policyholders with insurance counseling and recovery across virtually all policy lines.  Mr. Bourne also practiced in the leading policyholder coverage practices of Dickstein Shapiro LLP and Kasowitz, Benson, Torres & Friedman LLP.  Before entering private practice, Mr. Bourne served as a law clerk for the US Court of Appeals for the Second Circuit.

Mr. Bourne has written and spoken extensively on various insurance issues, and co-edited a treatise on sports and entertainment insurance coverage.  Mr. Bourne also has served on the Insurance Law Committee of the New York City Bar Association.  In addition, Mr. Bourne is a member of the Board of Directors of Children’s Future International, Inc., a not-for-profit organization that provides educational and other well-being programs to children in Cambodia.

Mr. Bourne received his B.A. in economics and political science from the University of Wisconsin-Madison, and his J.D. from Brooklyn Law School.  He is a member of the Bar of the State of New York, and is admitted to practice law before United States District Courts for the Eastern and Southern District of New York and the United States Court of Appeals for the Second Circuit.

Hoguet Newman Regal & Kenney Defeats Insurance Broker’s Motion for Summary Judgment on Behalf of Policyholder Client

As set forth in a Decision and Order dated January 14, 2016, we defeated a motion for summary judgment filed by our client’s former insurance broker. Our client has alleged that the broker failed to properly advise him regarding his need for workers’ compensation coverage. Justice Joseph Santorelli of the New York Supreme Court found that precluding summary judgment were issues of fact regarding the nature of the relationship and communications between the parties.

Hoguet Newman Regal & Kenney Wins Appeal of Denial of Insurance Broker’s Motion for Dismissal on Behalf of Policyholder Clienter Client

As set forth in a Decision and Order dated March 16, 2016, we convinced the Second Department to affirm the 2014 denial by the trial court of a motion to dismiss filed by our client’s former insurance broker. Our client has alleged that the broker failed to properly advise him regarding his need for workers’ compensation coverage.  The Second Department panel unanimously agreed with the trial court that the complaint “sufficiently alleged the existence of a special relationship between [the parties] so as to give rise to a duty to advise.”
